These Terms & Conditions ("Terms") govern your use of the Ecotours Vallarta website (the "Site") and any tour, activity, or service booked through it. By browsing the Site or booking a tour, you agree to these Terms. Please read them carefully.
1. About Ecotours Vallarta
Ecotours Vallarta is a nature-tourism operator based in Marina Vallarta, Puerto Vallarta, Jalisco, México, offering birdwatching, whale watching, snorkeling, hiking, and other outdoor tours in Puerto Vallarta and the Riviera Nayarit / Banderas Bay area. Legal responsibility for Ecotours Vallarta rests with Karel Beets Vigil.
2. Use of This Website
This Site is provided to inform you about our tours and to help you decide which one to book. You agree to use the Site only for lawful purposes and not to interfere with its normal operation, attempt to gain unauthorized access to it, or copy its content for commercial use without our written permission.
3. Bookings and Reservations
Bookings are completed directly on this Site. Payment is always due in full at the time of booking — we do not accept deposits or partial payments. Once payment is confirmed, you'll receive a confirmation email with a unique reservation code you can use to look up your booking at any time.
4. Pricing and Availability
Prices shown on this Site are the actual booking price for the selected date and format (shared or private): pages in Spanish publish in Mexican pesos (MXN) and pages in English publish in US dollars (USD). Where a tour has an online discount, the regular price is shown struck through next to the online price you actually pay. Availability and final price are confirmed at the moment you complete checkout, and are subject to change until then.
5. Cancellations and Refunds
Each tour page lists its own cancellation policy under "Cancellation Policy" — policies can vary by tour, so please review the specific tour's policy before booking. As a general rule, cancellations made further in advance of the tour date receive a larger refund than cancellations made close to, or on, the day of the tour; no-shows and late arrivals are typically not refunded. Tour activities may also be changed or cancelled due to weather or safety conditions, in which case we will offer a rescheduled date or a refund as appropriate.
6. Health, Safety, and Participant Requirements
Our tours take place outdoors and can involve activities such as hiking, snorkeling, or boat travel. Each tour page lists specific requirements under "Know Before You Book" — these can include fitness level, minimum age, maximum weight, or medical conditions that may make a tour unsuitable for you. It is your responsibility to review these requirements before booking and to disclose any relevant medical condition to your guide before the tour begins.
7. Assumption of Risk and Liability
Outdoor and adventure activities carry inherent risks, including but not limited to risks related to wildlife, weather, water, and terrain. By booking and participating in a tour, you acknowledge these risks and agree to follow your guide's safety instructions at all times. Ecotours Vallarta is not liable for injury, loss, or damage arising from circumstances outside our reasonable control, or from a participant's failure to follow safety instructions or disclose a relevant health condition.
8. Intellectual Property
All text, photos, videos, and other content on this Site belong to Ecotours Vallarta or are used with permission, and are protected by copyright. You may not reproduce, distribute, or use this content commercially without our prior written consent.
9. Third-Party Links and Services
This Site uses or links to third-party services we don't fully control, including Stripe (payment processing), Google Maps, and our social media pages. We aren't responsible for the content, terms, or privacy practices of those third parties.
10. Limitation of Liability
To the fullest extent permitted by law, Ecotours Vallarta is not liable for any indirect, incidental, or consequential damages arising from your use of this Site or participation in a tour, beyond the amount actually paid for that tour.
11. Governing Law
These Terms are governed by the laws of the United Mexican States and the State of Jalisco. Any dispute arising from these Terms or from a tour booking will be subject to the courts of Puerto Vallarta, Jalisco, México.
12. Changes to These Terms
We may update these Terms from time to time to reflect changes in our tours or policies. The "Last updated" date at the top of this page shows when it was last revised. Continuing to use the Site after a change means you accept the updated Terms.
